Abstract
Auto-Brewery Syndrome (ABS) presents unique challenges for lawyers, judges, and expert witnesses. Unlike many scientific disputes, ABS does not necessarily challenge the accuracy of alcohol testing. Instead, it raises questions about how alcohol-related evidence should be interpreted when endogenous ethanol production is a possibility. This article examines the legal and evidentiary issues associated with ABS claims, explores factors that may warrant further investigation, and discusses how courts can evaluate such claims while remaining grounded in objective medical and scientific evidence.
